BRM Responds to New FACTA Legislation

Business Records Management Responds

to New FACTA Legislation

Pittsburgh, PA – The Federal Trade Commission (FTC) has issued new rules that require local businesses to properly combat identity theft and protect privacy as governed by the federal Fair and Accurate Credit Transactions Act (FACTA), enacted in December 2003.  New FACTA legislation has a mandatory compliance date of November 1, 2008.

These FACTA “Red Flag Rules” dictate that all businesses that handle consumer information must develop and implement their own Identity Theft Prevention Program to protect their clients.  Failure to do so can result in steep fines, negative publicity, loss of business, audits and legal action.

This legislation will have a dramatic impact on the demand for document shredding, the growth of commercial secure destruction services and the reasons that proper document destruction is an important consumer protection issue.

Business Records Management (BRM), a leader in records and information management in Pennsylvania, provides secure document shredding services to businesses seeking to protect both competitive and personal information.  Demand for this service will increase significantly as a result of the new regulations, and BRM has already responded to this need.

Identity theft is still the biggest and fastest-growing crime in the United States, and the FACTA Red Flag Rules are the latest in a continuing stream of laws to stem its growth.

“These new rules are an important step forward in the fight against consumer fraud and identity theft.  Shredding documents and properly destroying computer files will help ensure that records containing sensitive personal and financial information don’t fall into the wrong hands,” said BRM president Steven Wright.  “It’s important for the business community to understand that this law applies to nearly every type of business in the U.S. that handles consumer information.”

Business Records Management operates facilities in Pittsburgh, Erie and Johnstown.  BRM provides information management services to over 3,000 organizations throughout western Pennsylvania, Ohio, West Virginia and parts of Maryland and New York.  Services include Document Storage and Management, Secure Document Shredding, Disaster Recovery, Software Escrow, Backup Tape Storage and Rotation, Email Retention, Imaging and Records Management Consulting.
